CHAPTER V. CITY CHARGES
(It is highly recommended that a separate Market Code be prepared)
ARTICLE A. FISHERY RENTALS, FEES AND CHARGES
ARTICLE A. PERMIT and RENTAL FEE for FISHERY ACTIVITIES

SEC. 245. IMPOSITION OF FEES
This Article shall govern the imposition, levy and collection of permit and rentals fees pursuant to “The Fishery Code of Alaminos, as amended” SEC. 246. PERSONS ELIGIBLE IN THE UTILIZATION AND EXPLOITATION OF

FISHERY/AQUATIC RESOURCES.
a. Citizens of the Philippines.
1. Residents of the barangay and their cooperative /association where the water is within the barangay’s jurisdiction-1st priority; 2. Residents of the neighboring barangay-2nd priority; b. Cooperatives, corporations partnerships or Associations duly registered or incorporated under the laws of the Philippines and authorized to transact business in the Philippines and at least sixty percent (60%) of whose capital stock belong wholly to citizens of the Philippines. SEC.248. LEASE AND PERMIT
No person shall exploit, occupy, produce, culture, capture or gather fish or fry or
fingering of any species of fish or fishery/aquatic products or engage in any fishery
activity in the City water of Alaminos without a lease or permit.
SEC. 249. PERMIT FOR THE OPERATION OF FISHING BOATS OF THREE (3) TONS OR
LESS
No person, cooperative, corporation and the like shall be granted to permit to
operate fishing boats of three (3) tons or less, non-motorized water craft, fishing with
nets, traps or other fishing gears, collection of fishery/aquatic products without securing
the requirements and payment of the fee herein imposed.
SEC.250. FISHING BOAT PERMIT
Permit issued to any person, cooperative, corporation, and the like shall be
valid for a year and renewable not later than January 20th of each year

Provided however, that such permit could be revoked/ cancelled any time within the year for justifiable cause: Provided further, that operators shall not operate within thirty (30) meters of any fish coral or fyke net except when the operator himself is the owner/operator of the fish coral or fyke net but in no case within thirty (30) meters of the said coral or fyke net: Provided finally, that permit shall be issued after payment of the following fees:
SEC. 251. - PERMIT OF FISHING GEARS
No person, cooperative, corporation and the like shall be granted license or
permit to gather fry or any fish species or any fishery/ aquatic products in the city waters
with nets, or other fishing gears with or without using fishing boats without first complying
with all the requirements herein imposed and the payment of fees hereunder stated:
Provided however, that no other fee shall be collected from fisherman, duly licensed by
other municipalities unless the license fees paid by him in the city origin are less than
what is imposed by this ordinance, the difference between the two shall be collected:
Provided further, that marginal fisherman who catch, gather fish in the City waters for
daily subsistence/home consumption only shall be exempted from securing license or
permit: Provided finally, that the license or permit issued shall be valid for a year and is
payable and renewable not later than January 20 of each year, however, said license or
permit shall be revoked or cancelled anytime within the year for reasonable cause.

SEC. 252. WHO MAY APPLY
A license/permit to construct, establish, or operate a fish pen, fish cage,
stationary-fishing gears maybe issued only to the following:
1. Fisherfolk cooperative or association of marginal fishermen duly registered and
established in the barangay- 1st priority; 2. Residents of the barangay where fish pen, fish cage, stationary gears be set up – 2nd 3. Residents of neighboring barangays – 3rd priority. 4. Cooperatives, corporations and the like, duly registered in accordance with law and at least sixty percent (60%) of the authorized capital stock of which belongs wholly to citizens of the Philippines. RESOURCES

ARTICLE B. RENTAL / FEES FOR THE USE OF REAL AND PERSONAL
PROPERTIES, VARIOUS SERVICES, FACILITIES, UTILITIES OWNED/
ADMINISTERED

INCLUDING THOSE AT THE HUNDRED ISLANDS NATIONAL PARK, LUCAP WHARF
AND FISHPORT.


SEC. 256. IMPOSITION OF FEES
There shall be collected fees for the use of city properties /facilities in
accordance with the following schedules:
A. PENSION HOUSE (Lucap Wharf)


B. CONCESSIONER’S RENTAL
(subject to 10% increase yearly) P 475.00

C. ENTRANCE FEE (Exempted 5 years old below and 20% discount for Senior
Citizens).
Note: No overnight shall be allowed on underdeveloped islands. Bonfire is strictly not allowed on beaches. E. PARKING FEE (Lucap Wharf and Fish Port) (Lucap Wharf and Fish Port) 20.00/day, plus P1.00 for succeeding day for each boat tied at the mooring area. G. BOAT RIDES (Private)-Plus P 200.00 for Island Hopping Note: Hired motorboats should stay in the islands where their every succeeding hours during peak season. 2. Double for every succeeding hours during the lean peak season. K. OTHER FACILITIES a. Picnic d. Adventure Hundred Islands Boat (for package only) L. “Bayanihan Center for the Rural Development” M. Covered court auditorium (Don Leopoldo Sison) SEC. 257. EXEMPTION
Parking fee shall not be collected from the following:
a. Official vehicles of the United States Armed forces or other employees of the b. Official vehicle of the Armed forces of the Philippines. c. Official vehicle of the Philippine National Police. d. Official vehicles of the National/Provincial, City, or Barangay officials and employees; anyone traveling on feet, mounted by animal, alone, or accompanying animal. e. Vehicle traveling which is engaged primarily in the delivery of mail. f. Ambulance g. Vehicle loading/ unloading good/passengers only.
SEC. 257-A. Time of Payment- the rental/fees imposed herein shall be paid to
the City
Treasurer or his duly authorized representative, before the use services/facilities /utilities or occupancy of the property.
SEC. 257-B. Penalty- Any person found to have violated any of the provision of
this Article shall be fined twice the amount of fee prescribed in the preceding
section
(Section 256).
ARTICLE C. SOLID WASTE MANAGEMENT FEES

SEC. 258. IMPOSITION OF FEE
There are hereby imposed fees in the amount sufficient to pay the cost of
preparing, adopting and implementing the comprehensive Solid Waste Management
Ordinance pursuant to R.A 900, Chapter V, and Section 48.
The fee shall be collected from every household owners/ lessees, commercial, industrial, and institutional establishments located within the coverage of the garbage collection area. Schedule of Solid Waste Management Fees
a. Big industries such as metal smelting b. Medium scale, big scale furniture manufacturers garment factory, concrete asphalt mixing plant, tire c. Small scale industries, rice, corn, and feed mills, manufacturers or brick tiles, ceramic pipe and other concrete products, bihon, miswa, noodles manufacturing u. Copying machines, wood frames, and photocopy shop b. Medical clinics with patients, confinements facilities c. Medical and dental Clinic, X-rays, Ultrasound, CT scan c. Elementary, Kinder and Nursery Schools 6. Energy, Transport and Communication Firm a. Accounting, Lawyers, Civil; State Advertising offices, a. Chicken Dealer with Chicken Dressing Fauces b. Coconut and Buko Dealer with Wholesaler
SEC.259. The fee imposed in this Ordinance shall be paid to the City Treasurer or
his/her authorized representative either monthly or annually. If the option selected is in a
monthly basis, it shall be paid before fifth (5TH) day of every month .If annually it shall be
paid in advance within the first twenty (20) days of January every year.
The fees collected shall be used to pay the actual cost incurred by the City Government that are directly related to adoption and implementation of the Solid Waste
Management Plan,
the setting and collection of local fees.
SEC. 260. PROHIBITED ACTS
The following acts are prohibited:
1. Undertaking activities or operating, collecting or transporting equipment in violation of
sanitation operation and other requirements or permits set forth in or established pursuant to the Ordinance; 2. The open burning of Solid waste; 3. Causing or permitting the collection of non-segregated of non –segregated or 4. Squatting in open dumps and landfills; 5. Open dumping, burying or biodegradable or non biodegradable materials in flood 6. Unauthorized removal of recycle, materials intended for collection by authorized 7. The mixing of source separated recyclable materials with other solid waste in any vehicle, box, container, or receptacle in solid waste collection or disposal; 8. Establishment or operation of open dumps as enjoined in the Ordinance or closure of said dumps in violation of Sec.6 of the Ordinance. 9. The manufacturer, distribution or use of non-environmentally acceptable packaging 10. Importation of consume products packaged in non-environmentally acceptable 11. Importation of toxic wastes misrepresented as “recyclable “OR WITH “recyclable 12. Transport and dumping in bulk of collected domestic, industrial, commercial, institutional wastes in areas other than centers of facilities prescribed under this Ordinance 13. Site preparation, construction, expansion or operation of waste management facilities without an environmental Compliance Certificate required pursuant to the Presidential Decree No. 1586 and the Ordinance not conforming with the land Plan of the LGU. 14. The construction of any establishment within two hundred (200) meters from the open dump or controlled dumps or sanitary landfills; and 15. The construction or operation of landfills or any waste disposal facility on any aquifer, groundwater reservoir or watershed area and/or any porting thereof. The Commission may also issue further guidelines that the consider existing and relevant laws and regulations, and which may further define the scope and coverage of
the above prohibited ordinance.
SEC. 261. SPECIFIC
PROHIBITION AGAINST THE USE OF OPEN DUMPS FOR SOLID
No open dumps shall be established and operated, nor any practice or disposal of solid waste by any person, including LGU’s with constitutes the use of open dumps
for Solid waste, be allowed after the effectivity of the Ordinance. Provided, that within
three (3) years after the effectivity of the Ordinance , the City shall convert its open
dumps into controlled dumps; Provided further , that no controlled dumps shall be
allowed five (5) years following effectivity of the Ordinance.
SEC. 262. FINES AND PENALTIES
a. Any person who violates Sec.299 pars. (1) and (3) shall, upon convention , be
furnished with a fine of not less than three hundr ed pesos (300.00) but not more than
one thousand pesos (1,000.00) or imprisonment of not less than one (1) day but not
more than fifteen (15) days , or both;
b. Any person who violates Sec.299. pars. (4), (5), (6) and (7) shall upon conviction , be
punished with a fine on not less than One thousand pesos (1,000.00) but not more than
three thousand pesos (3,000.00) or imprisonment of not less than fifteen (15) days but
not more than six (6) months , or both;
c. Any person who violates Sec.299 pars. (8) , (9) ,(10) and (11) for the first time shall
upon conviction , pay a fine of Five Thousand Pesos (5,000.00) plus an amount of not
less than five percent (5%) but not more than ten percent (10%) of his net annual
income during the previous year.
d. Any persons who violates Sec.299, pars (12) and (13) shall upon conviction be
punished by a fine of not less than One thousand pesos (1,000.00) but not more than
Two thousand pesos (2,000.00) or imprisonment of not less than thirty (30) days but
not more than one (1) years, both,
e. Any person who violates Sec.299, pars. (14) And (15) shall upon conviction , be
punished with a fine not less than One Thousand Pesos (1,000.00) but not more than
five thousand Pesos (5,000.00) or imprisonment not less than one (1) year
If the offense committed by corporation, partnership, or other juridical entity duly organized in accordance with law, the chief executive officer, president, general manager, managing partner, or such officer in charge shall be liable for the commission of the offense penalized under this Ordinance. If the offender is an alien, he shall after service of the sentence prescribed above, he deported without further administrative proceedings. The fine herein imposed shall be increased by at least ten percent (10%) every three (3) years to compensate for inflation and to maintain different function of such fines. SEC. 263. REPEALING CLAUSE
All rules and regulations or part of said rules and regulations of pertinent
laws inconsistent with the these Rules and Regulations are hereby revised , amended,
modified, and or/ suspended .
ARTICLE D .PARKING FEES

SEC. 264. IMPOSITION OF FEES
There shall be collected fees for the use of City owned parking areas in
accordance with the following schedules:
h. Tricycles for hires 165.00/annum i. Other vehicles except caleza j. An overnight parking fee shall be charged for parking in the parking areas maintained and or operated by the city, or on city national roads maintained by the city at any time between 8.00 o’clock P.M and 7.00 A.M the following morning as follows: 2. Cars,Jeeep , Jeepneys and other motor vehicles 3. For container vans/trailer, per day or fraction thereof
SEC. 265. TIME OF PAYMENT
The fee herein imposed shall be paid to the City Treasurer or his duly
authorized representative upon parking thereon

SEC. 266. EXEMPTION
Parking fee shall not be collected from the following:
a. Official vehicles of the United States Armed forces or other employees of the United
b. Official vehicle of the Armed forces of the Philippines. c. Official vehicle of the Philippine National Police d. Official vehicles of the National Provincial, City or Barangay officials and employees; Anyone traveling on feet or mounted by animal, alone or accompanying animal.

SEC. 267. RULES AND REGULATIONS

f. No motor vehicle shall be allowed to park in any other place of the City except in the
parking space designated for the purpose. g. The parking space shall be open from six o’clock and the morning and shall be close h. The Station commander of the Philippine National Police shall see to the compliance ARTICLE E.CEMETERY CHARGE/RENTAL

SEC. 268. IMPOSITION OF RENTAL
The City Treasurer shall collect rentals of grounds within the City cemetery
compound in accordance with the rates herein fixed as follows:
1. CemeteryLot (old cemetery) 2. Rental fees-ready made tomb 3. Rentals ready made niches –renewable every 6 years
4. Rental fees-lawn type- renewable every

SEC. 269. A contract of lease, shown in Annex “D” shall be executed by every
Cemetery lessee.

SEC. 270. TIME OF PAYMENT
For each burial lot or niche shall be paid in advance to the City Treasurer prior
the interment and on the anniversary date as regard subsequent rentals for the lease
that are renewed. Non-payment of rentals the anniversary date shall be subject to
imposition of surcharge in interest.
SEC. 271. SURCHARGE FOR THE LATE PAYMENT
Failure to pay the tax prescribed in this article within the time required shall
subject the taxpayer to a surcharge of twenty five percent (25%) of the original amount
of tax due such surcharge to be paid at the same time and in the same manner as the
tax due.

SEC. 272.
INTEREST OF LATE PAYMENT
In addition to the surcharge imposed.
Here in there shall be imposed an interest of fourteen percent (14%) per annum upon the unpaid amount from the tax due until the tax is fully paid.

SEC. 273.
RULES AND REGULATION.

(a) Place of Burial- Except of such cases may be allowed existing provisions of the laws,
it shall be unlawful for any person to bury or intern or cause to be buried or interred either or temporarily or permanently dead body or human remains. (b) Death certificate for burial- A dead body or human remain shall not be buried without a certificate of death duly issued by the attending Physician or City Health Officer or if no medical officer is available. The City mayor, City Secretary or one of the City Councilors. (c) Permit to construct- Any construction of whatever kind or nature in the Public cemetery, whether or temporary of perpetual use, shall only be allowed after the approval of the permit issued by the City Mayor, upon the recommendation of the City health Officer. (d) Renewal of Lease- In case of the leasee intends to renew the lease after the termination, he must inform the City Mayor within thirty (30) days before the expiry date of the lease, and shall pay the corresponding rental fee thereof. It shall be the duty of the City Treasurer shall send reminder for the expiration his lease two weeks before the expiration of the lease. (e) Registrar - The City Treasurer shall keep a register on accounts of the Cemetery along with the additional information as maybe required by the Sangguniang Panlungsod. ARTICLE F. SLAUGHTERHOUSE, CORRAL, LIVESTOCKS MARKET CHARGES

SEC. 274.
IMPOSITION OF SLAUGHTER FEES
There shall be collected fees from any person slaughtering the following:
HOGS/ GOAT/HEAD
Before the issuing the permit for the slaughter house of large cattle, the City Treasurer or his duly authorized representative shall require, for branded cattle the production of the certificate of ownership if the owner is the applicant, or the original certificate of ownership and the certificate of transfer showing the name of the person applying for the permit if he is not the original owner .If the applicant is not the original owner ,and there is no certificate of transfer made in favor, one such certificate shall be in issued and corresponding fee collected therefore. For unbranded cattle, that have not yet reached the age of branding, the City treasurer shall require such evidence as will be satisfactory to him regarding the ownership of the animal for which permit to slaughter has been requested. For unbranded cattle of the required age, the necessary owner and the transfer certificates shall be issued and the corresponding fees collected therefore before the slaughter permit is granted. The City treasurer or his/her duly authorized representative shall see to it that the animal shall not be sold outside the Livestock Market. SEC. 276. LIVESTOCKS MARKET FEE/ CHARGES

SEC. 277. VETERINARY CERTIFICATE FEE
There is hereby imposed a veterinary certificate fee for every livestock, cattle, and
fowl to be transported to other municipalities which shall be paid to the City Treasurer in
accordance with the following schedule to wit;
SEC. 278. REGISTRATION FEE FOR LIVESTOCK BUSINESS
There are hereby imposed fees or charges from any person with the business of SEC. 279. ADMINISTRATIVE SANCTION
The Livestock/cattle mentioned in the preceding section shall not be allowed to be
transported if the owner or anyone in charge/ possession thereof fails/refuses to pay the
corresponding veterinary certificate fee to the City Treasurer or his duly authorized
representative of the City of Alaminos.
SEC. 280. TRANSPORTATION /FEES TO BE COLLECTED:

Only the authorized driver and employees shall be with the Meat delivery van while 6. It is driver’s responsibility to always keep the door of the meat delivery van closed while in travel and until it reaches its destination. 7. All private Meat delivery vans conducting business in the city of Alaminos shall be registered/ accredited by the office of the City Mayor through the veterinarian office and shall pay the amount of P 150.00 annually, as accreditation fee to the city treasurer. 8. It shall be the duty of any livestock raise and merchant to register his business with the city Treasurer within one (1) month from the start of said business. SEC. 281. PENAL PROVISION:
1. Any person firm or corporation found violating any provision of this article shall pay the fine of P 250.00 or an imprisonment of 2 days, or both such fine and imprisonment at the discretion of the court. 2. The meat delivery van used to distribute and/ or transport meat products shall be impounded by the POSO and meat/meat products confiscated shall be disposed by the City Veterinarian or his authorized representative. ARTICLE G. MEAT INSPECTION FEES

SEC. 282.

ACCREDITATION FEES OF SLAUGHTERHOUSE, POULTRY
DRESSING PLANT,
COLD STORAGE AND MEAT DELIVERY VAN.

For the issuance of Certificate of Accreditation to public and/or private slaughterhouse. poultry dressing plant, meat processing plant, meat cold storage and meat conveyance after having been evaluated and classified for purposes of standardization, the following fees shall be collected: “AA” Slaughterhouse/Poultry Dressing Plant/ “A” Slaughterhouse/Poultry Dressing Plant/ c. “B” Slaughterhouse/Poultry Plant/--
SEC. 283. LABORATORY FEES FOR THE EXAMINATION OF MEAT AND MEAT

PRODUCTS
For the proper identification and diagnosis of disease condition of meat and meat products submitted for laboratory examination, the fees are as follows: d. Pathological Examination iv. Cattle/Carabao/Horse, up to 2 months Nitrite/Nitrites 100.00 Starch 100.00 Salt/M.S.G. SEC. 284. FEES FOR THE ISSUANCE OF LICENSE TO MEAT HANDLERS
For the service in training, advisory and other relevant packages of technological
training rendered to meat processors, dealers, vendors, butchers, dressers and cutters,
the following fees shall be collected:
